Terms & Conditions
Terms and Conditions of Quinta da Bravura, Lda. In case of discrepancies between language versions, the Portuguese version prevails.
1. Scope of Application & Corporate Identity
Scope: These Terms and Conditions apply to all contracts regarding wine tastings, tours, and the purchase of goods at the estate or via our online shop.
Provider: Quinta da Bravura Lda., registered office at Rua Francisco Xavier Ataíde de Oliveira, Lote 33, Loja F, 8600-775 Lagos, Portugal, corporate tax number (NIF) 516198602, email: legal@terracosdaluz.com.
2. Age Restrictions
Legal Age: In accordance with Portuguese law, the sale and consumption of wine is strictly prohibited to individuals under 18 years of age.
Verification: By placing an order or booking a tasting, the customer certifies that they are at least 18 years old. The winery reserves the right to request official photo identification at the estate.
3. Wine Tastings & Event Bookings
Confirmation: Bookings for wine tastings, vineyard tours, or events are only binding upon written email confirmation and full advance payment.
Cancellation by Customer: Cancellations made up to 72 hours before the scheduled event will be fully refunded. Cancellations after this period or no-shows are non-refundable.
Exclusion of Withdrawal: Pursuant to Portuguese consumer law, the statutory 14-day right of withdrawal does not apply to services related to leisure activities that provide for a specific date of performance.
4. Terms of Sale & Wine Delivery
Availability: All products and specific wine vintages are subject to stock availability. If a specific vintage is sold out, we will contact you to offer an equivalent alternative or a refund.
We operate strictly on an advance payment only basis via bank transfer; no other payment methods are accepted.
The full invoice amount must be received on our bank account within 5 business days after the order confirmation, otherwise the order will be automatically cancelled.
No items will be packaged or dispatched before full payment is received.
Delivery times within mainland Portugal take approximately 2 to 5 business days, and international EU shipments take approximately 5 to 10 business days.
The delivery period begins strictly on the business day following the actual receipt of the full payment on our bank account.
Prices & Taxes: All prices are listed in Euros (€) and include the current statutory Portuguese Value Added Tax (IVA) for wine and for tastings/services in mainland Portugal. Shipping costs are displayed separately before checkout.
Retention of Title: All goods remain the sole property of the winery until full payment has been received.
5. Right of Withdrawal (Online Purchases Only)
Cooling-off Period: For online orders, EU and Portuguese law grants consumers a 14-day right to withdraw from the contract without giving any reason. The period begins the day the goods are delivered.
Conditions: The wine must be returned unopened, in its original packaging, and undamaged. The customer bears the direct cost of shipping the goods back to the winery.
6. Warranty, Defects & Complaints
Defects: In the event of damaged bottles or cork taint (corked wine), the legal Portuguese warranty for consumer goods applies. The customer must notify the winery immediately upon discovering the defect.
Since wine is a natural product, changes and characteristics resulting from biological or physical processes do not constitute defects. In particular, the presence of winestone (crystal precipitation) or a natural deposit (sediment in red wines) does not affect the quality of the wine and does not constitute a material defect. A subjective dislike of the taste does not justify a warranty claim.
Complaints: We value customer satisfaction. If you are unsatisfied, you can access our official Complaints Book (Livro de Reclamações) at our physical estate or digitally via the government portal at www.livroreclamacoes.pt.
7. Alternative Dispute Resolution (ADR / RAL)
Statutory Notice: Pursuant to Portuguese Law no. 144/2015, we inform consumers that in the event of a dispute, they may appeal to an Alternative Dispute Resolution Entity.
Competent ADR Entity: Centro de Arbitragem de Conflitos de Consumo do Algarve (CIMAAL), Av. 5 de Outubro, 55, R/C Dto., 8000-075 Faro, Portugal – www.consumoalgarve.pt. Further information on alternative dispute resolution is available on the Portuguese Consumer Portal at www.consumidor.gov.pt.
8. Applicable Law and Jurisdiction
Governing Law: These Terms and Conditions and all contracts derived from them are governed exclusively by Portuguese Law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Jurisdiction: For contracts with commercial entities, the exclusive place of jurisdiction is the court corresponding to the winery's registered seat (Tribunal Judicial da Comarca de Faro / Juízo de Lagos). Statutory courts apply to private consumers.
